Another mile stone for Delhi Patent Office.
Another mile stone for Delhi Patent Office. Patent office has started punching system. Now onwards, if you wants to meet an examiner or have some other work, you need to punch your card to get into the main building. This system will help office to keep a check on people. The cards has a specific number assigned to visitor. We expect more development at Delhi Patent Office in coming future.

This time patent agent exam has been delayed by Indian Patent Office But finally they are going to take in December 2008.
I have heard saying one of the controller that they had a lot of pressure to conduct this examination. The Controller also said that they may restrict conducting this exam onces in a year only from 2009 onwards.

Freedom to Operate Review for a new product is to seek an objective opinion that the said product will not infringe any valid claims of issued patents that are known to the company or that are so obvious that they should have been known to the company. Keyword search in available patent databases such as Big Patents India (for India), NIC site, Patent Journal Search, Sci-finder Search, STN search etc and a review of competitors patent portfolios should be first step to find any issued patents that have claims that are closely related to the product. Search should be condcuted by a qualified searcher. In case of pharma products, generic names, chemical formula, chemical name and chemical struture should be used.

"Freedom to operate", abbreviated "FTO", is usually used to mean determining whether a particular action, such as testing or commercialising a product, can be done without infringing valid intellectual property rights of others.
Since IP rights are specific to different jurisdictions, a "freedom to operate" analysis should relate to particular countries or regions where you want to operate.
